This website is operated by Artist Unlock LLC. Throughout the website, the terms “Artist Unlock,” “we,” “us,” and “our” refer to Artist Unlock LLC.

Artist Unlock offers this website, including the information, products, tools, and services available through it, subject to your acceptance of these Terms of Service and the other policies referenced in them.

By visiting our website, placing an order, uploading a photograph, or otherwise using our services, you agree to these Terms of Service. These Terms apply to all users of the website, including browsers, customers, and anyone who submits content through the website.

Please read these Terms carefully. If you do not agree to them, you may not use the website or purchase products from us.

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products and services to you.

1. Eligibility and Online Store Terms

You must be at least 18 years old or the age of legal majority in your place of residence to place an order.

A parent or legal guardian must place an order on behalf of a minor.

You may not use our website or products for any illegal or unauthorized purpose. You may not violate any applicable law through your use of the website, including copyright, trademark, privacy, consumer-protection, or electronic-commerce laws.

You must not transmit viruses, malicious code, or other technology intended to damage or interfere with the website or another person’s use of it.

A violation of these Terms may result in cancellation of an order, restriction of access, or termination of your use of the website.

2. General Conditions

We reserve the right to refuse service, cancel orders, restrict purchases, or limit access to the website when reasonably necessary, including in cases of suspected fraud, misuse, unlawful activity, payment problems, prohibited content, or violations of these Terms.

You may not reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the website or services without our prior written permission.

Information you submit through the website may be transmitted through third-party networks and adjusted as technically necessary to operate the website, process payments, produce products, and fulfill orders. Payment-card information is processed through secure payment providers and is encrypted during transmission as required by those providers.

The headings in these Terms are provided for convenience and do not limit or otherwise affect their meaning.

3. Product Information

We make reasonable efforts to describe and display our products accurately. However, product descriptions, photographs, prices, measurements, availability, and other information may occasionally contain errors or omissions.

Colors displayed on a computer, phone, or tablet may differ from the physical canvas, printed materials, paint, frame components, or finished artwork because of differences in screens, lighting, printing, materials, and manufacturing.

Paint colors and the number of paint colors included may vary by design. Product photographs may show representative examples. Your kit will contain the design and options you select when ordering.

Frames, accessories, upgrades, promotional products, and other components are included only when expressly identified as included with the product option you select.

We may correct errors, update product information, change prices, discontinue products, or limit available quantities at any time. If an error affects an order you have already submitted, we may contact you, correct the order with your approval, or cancel the affected order and issue an appropriate refund.

Any offer made through the website is void where prohibited.

4. Paint-by-Numbers Products and Results

Paint-by-numbers kits are intended to produce an artistic painted interpretation of a design or photograph.

Reference images, previews, and product photographs are illustrative. We do not guarantee that the completed painting will be an exact photographic reproduction or will precisely match the colors shown on a screen.

Results may vary based on painting technique, paint application, lighting, canvas texture, color perception, assembly, and the customer’s adherence to the provided instructions.

Some designs may require multiple coats of paint for full coverage. Small details, color transitions, and other characteristics may appear differently in the completed physical painting than they appear in a digital preview.

5. Custom Photo Products

Certain products allow you to upload a photograph for conversion into a custom paint-by-numbers kit.

Unless a product page expressly states otherwise, our custom pet-photo products are intended for photographs of dogs. You should not upload photographs containing identifiable people or content unrelated to the permitted custom product.

By uploading a photograph, you confirm that:

1. You own the photograph or otherwise have the right and permission necessary to use and submit it;

2. Artist Unlock’s use of the photograph as permitted by these Terms will not violate another person’s copyright, trademark, privacy, publicity, contractual, or other rights;

3. The photograph does not contain unlawful, harmful, deceptive, defamatory, obscene, or infringing material; and

4. You are authorized to grant the permission described below.

You retain any ownership rights you have in your original photograph.

You authorize Artist Unlock and the service providers involved in producing and fulfilling your order to host, store, access, crop, resize, edit, simplify, recolor, reproduce, transmit, convert, and otherwise process the photograph as reasonably necessary to:

• Create your custom paint-by-numbers design;

• Produce and fulfill your order;

• Deliver the product to you;

• Provide customer service;

• Address quality, payment, or order disputes; and

• Maintain records reasonably necessary for legal, tax, fraud-prevention, and business purposes.

This permission is limited, nonexclusive, and royalty-free. It does not transfer ownership of your original photograph to Artist Unlock.

We will not use your uploaded photograph publicly in advertising, product listings, social-media content, livestreams, or other marketing materials unless you separately give us permission.

We may reject a photograph, request a replacement, or cancel the affected custom product if we reasonably believe the photograph:

• Violates these Terms or another person’s rights;

• Contains an identifiable person;

• Does not primarily depict a dog;

• Is inappropriate or unlawful;

• Is too blurry, dark, cropped, obstructed, or low-resolution to use effectively; or

• Is otherwise unsuitable for conversion into a paint-by-numbers kit.

Custom designs may require cropping, background removal, color changes, detail simplification, repositioning, or other artistic and technical adjustments. The completed design will be an artistic conversion and will not be identical to the original photograph.

You are responsible for any photograph you submit and for obtaining the rights and permissions necessary to use it.

6. Reviews, Feedback, and Other Submissions

You may choose to submit reviews, finished-painting photographs, comments, suggestions, ideas, or other feedback.

You agree that your submissions will be truthful and will not violate another person’s intellectual-property, privacy, publicity, or other rights. You may not submit unlawful, threatening, abusive, defamatory, obscene, deceptive, or malicious content.

When you voluntarily submit a public review, finished-painting photograph, testimonial, social-media response, or similar material for publication, you grant Artist Unlock a nonexclusive, royalty-free permission to display, reproduce, edit for length or formatting, and use that submission in connection with our website and marketing.

This section does not give us permission to use a private photograph uploaded solely for creation of a custom kit. Custom photo uploads are governed by Section 5.

We may remove or decline to publish submissions that violate these Terms or that we reasonably consider inappropriate, misleading, or unrelated.

7. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted or can be fulfilled.

We may refuse, limit, or cancel an order because of:

• Product unavailability;

• Pricing or description errors;

• Incorrect billing or shipping information;

• Payment failure or suspected fraud;

• Prohibited or unusable uploaded content;

• Unusual quantities or suspected unauthorized resale;

• Technical or fulfillment problems; or

• A violation of these Terms or another Artist Unlock policy.

We may limit quantities purchased by the same person, account, household, payment method, billing address, or shipping address.

If we change or cancel an order, we may attempt to notify you using the email address, telephone number, billing address, or other contact information supplied with the order.

If we cancel an order after collecting payment, we will issue the appropriate refund through the original payment method when reasonably possible.

8. Billing and Account Information

You agree to provide current, complete, and accurate order, billing, shipping, payment, and contact information.

You represent that you are authorized to use the payment method submitted with your order.

You are responsible for reviewing your order before completing checkout, including the selected design, product options, frame selection, quantity, uploaded photograph, shipping address, and contact information.

Please contact us promptly if you discover an error. We cannot guarantee that an order, shipping address, or custom-photo submission can be changed after processing or production begins.

9. Prices, Discounts, and Promotions

Prices are shown in U.S. dollars unless otherwise stated and may change without notice.

Applicable taxes, shipping costs, and other charges will be displayed during checkout when required.

Discounts, free gifts, bundles, free-shipping offers, and other promotions are subject to their stated terms, eligibility requirements, exclusions, availability, and expiration dates.

Unless expressly stated otherwise:

• Promotions may not be combined;

• Free gifts and discounts have no cash value;

• Promotional items are available only while supplies last;

• Returned or canceled products may affect promotional eligibility; and

• We may cancel or correct a promotion affected by an error, fraud, abuse, or technical problem.

Returns involving discounted products, bundles, or free gifts are governed by our Return Policy.

10. Shipping and Delivery

Processing times, custom-production estimates, shipping methods, delivery estimates, and other shipping information are described in our separate Shipping Policy and on applicable product pages.

Custom products may require additional production time before shipment.

Delivery dates are estimates unless we expressly guarantee a date. Delivery may be affected by carriers, weather, holidays, customs, address errors, and other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. Additional shipping charges caused by an incorrect or incomplete address may be your responsibility to the extent permitted by law and our Shipping Policy.

If we cannot ship an order within the promised or legally required timeframe, we will provide the notice, cancellation opportunity, delay-consent request, or refund required by applicable law.

Title and risk of loss pass as provided by applicable law.

11. Returns, Exchanges, Refunds, and Cancellations

Returns, exchanges, replacements, refunds, and order cancellations are governed by our separate Return Policy, which is incorporated into these Terms by reference.

Different rules may apply to custom products, standard products, opened products, used products, damaged products, incorrect orders, promotional items, and orders that have already entered production.

Please review the Return Policy before placing an order.

Nothing in these Terms or our Return Policy limits any consumer right that cannot legally be waived.

12. Product Safety and Proper Use

You agree to read and follow all product instructions, labels, warnings, assembly guidance, and age recommendations.

Paint, paint containers, brushes, fasteners, wooden frame components, packaging, and other kit contents may present risks if swallowed, misused, handled improperly, or provided to children without appropriate supervision.

Paint and other kit contents are not food and must not be swallowed. Small components should be kept away from young children and anyone likely to place them in their mouth.

Use care when handling wooden pieces, fasteners, and tools during frame assembly. Adult assistance or supervision should be used when appropriate.

You should discontinue use of any product or component that appears damaged or unsafe and contact us when appropriate.

Artist Unlock is not responsible for damage or injury caused by misuse, failure to follow instructions or warnings, unauthorized modification, improper storage, or use inconsistent with a product’s intended purpose, except to the extent responsibility cannot legally be excluded.

13. Intellectual Property

The website and its contents—including Artist Unlock’s name, logo, branding, graphics, photographs, product descriptions, videos, instructions, layouts, artwork, designs, and software—are owned by or licensed to Artist Unlock and are protected by applicable intellectual-property laws.

You may use the website for personal shopping and informational purposes only.

Without our prior written permission, you may not:

• Copy or commercially reproduce our website or materials;

• Sell, license, distribute, or exploit our content;

• Use our branding in a way that suggests endorsement or affiliation;

• Remove copyright, trademark, or ownership notices;

• Scrape or systematically collect website content or customer data;

• Interfere with or reverse engineer website functionality; or

• Reproduce or sell our artwork or designs.

Purchasing a physical product does not transfer any copyright, trademark, digital design file, or other intellectual-property right associated with that product.

14. Third-Party Services and Links

We may use or provide access to services operated by Shopify, payment processors, file-upload providers, shipping carriers, review platforms, social-media services, and other third parties.

Third-party services may be provided “as is” and may be subject to separate terms and privacy policies. We do not control and are not responsible for third-party websites, services, content, availability, security, or practices.

Links to third-party websites are provided for convenience and do not necessarily constitute an endorsement.

You should review the applicable third party’s terms and policies before using its services or completing a transaction through it.

15. Personal Information

Our collection, use, storage, and disclosure of personal information are governed by our separate Privacy Policy.

The Privacy Policy includes information relating to customer accounts, orders, payments, website usage, cookies, uploaded photographs, service providers, and privacy choices.

By using the website, you acknowledge that your information will be processed as described in the Privacy Policy.

16. Errors and Omissions

The website may occasionally contain typographical errors, inaccurate information, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, availability, or other matters.

We may correct errors, update information, or cancel affected orders at any time, including after an order has been submitted.

We are not required to update every item of information except as required by law. A date shown as updated or refreshed does not necessarily mean that all information on the website was changed.

17. Prohibited Uses

You may not use the website, its content, or our services:

• For an unlawful or fraudulent purpose;

• To violate any applicable law or regulation;

• To infringe our rights or another person’s rights;

• To upload false, misleading, unlawful, or unauthorized content;

• To transmit viruses, malicious code, or other harmful technology;

We do not guarantee that the website will always be uninterrupted, secure, timely, compatible with every device, or free from errors.

Except for any express warranty we provide and any warranty that cannot legally be excluded, products and services are provided without additional express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Some states do not permit certain warranty exclusions. In those states, these exclusions apply only to the maximum extent permitted by law.

19. Limitation of Liability

To the fullest extent permitted by law, Artist Unlock LLC and its owners, employees, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the website or purchase of a product, including lost profits, lost data, or business interruption.

To the fullest extent permitted by law, Artist Unlock’s total liability for a claim relating to a particular order will not exceed the amount you paid to Artist Unlock for the product giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury, or any other liability that cannot legally be limited or excluded.

Because some jurisdictions do not permit certain liability limitations, these limitations apply only to the maximum extent permitted by applicable law.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Artist Unlock LLC and its owners, employees, contractors, and service providers from third-party claims, damages, liabilities, judgments, and reasonable legal costs arising directly from:

• A photograph or other content you submitted without the necessary rights or permission;

• Your violation of another person’s copyright, trademark, privacy, publicity, or other rights;

• Your fraudulent or unlawful use of the website; or

• Your material violation of these Terms.

This obligation does not apply to the extent a claim was caused by Artist Unlock’s gross negligence, willful misconduct, or use of your content outside the permission granted by these Terms.

We may control the defense of a covered claim, and you agree to provide reasonable cooperation.

21. Termination

These Terms remain effective unless terminated by you or us.

You may stop using the website at any time.

We may terminate or restrict your access, cancel pending orders, or refuse future service if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created legal, security, or operational risk.

Any payment obligation or provision that logically should survive termination—including intellectual-property, disclaimer, limitation-of-liability, indemnification, and dispute provisions—will remain effective.

22. Governing Law and Disputes

These Terms and purchases from Artist Unlock are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.

Before filing a legal claim, you and Artist Unlock agree to make a reasonable, good-faith effort to resolve the dispute informally. You may begin this process by emailing hello@artistunlock.com with a description of the issue and the resolution you are requesting.

Subject to any right that cannot legally be waived, legal proceedings relating to these Terms or a purchase from Artist Unlock must be brought in a state court located in Brown County, Texas, or a federal court with jurisdiction over Brown County, Texas.

Either party may bring an eligible claim in small-claims court.

These Terms do not require arbitration and do not contain a class-action waiver.

23. Changes to These Terms

We may update these Terms to reflect changes in our website, products, services, policies, operations, or legal obligations.

The current version will be posted on this page with its last-updated date.

Changes apply from the date they are posted unless otherwise stated. Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.

Changes will not retroactively alter the essential terms of an order already accepted unless required by law or agreed by both parties.

24. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted or modified only as much as necessary to make it enforceable.

The remaining provisions will continue in full force and effect.

25. Entire Agreement and Waiver

These Terms, together with our Return Policy, Shipping Policy, Privacy Policy, and any product-specific terms displayed before purchase, constitute the entire agreement between you and Artist Unlock regarding your use of the website and purchase of products.

If a product-specific term expressly conflicts with these Terms, the product-specific term controls for that product.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
